1. What XauLab is
XauLab ("XauLab", "we", "us") is a software tool for building, backtesting, generating and automating trading strategies, mainly for gold (XAU/USD). It can also send orders to a MetaTrader 5 (MT5) account that you connect and control.
XauLab is a technology service only. We are not a broker, dealer, exchange, portfolio manager, investment adviser or research analyst. We are not registered with the Securities and Exchange Board of India (SEBI) or any other financial regulator, and we do not hold or manage your money.
2. No investment advice
Nothing on XauLab is investment, financial, legal or tax advice, or a recommendation to buy or sell anything. This includes strategies, backtest results, generator results, featured or marketplace strategies, charts, statistics, guides, emails and support replies.
Any strategy you build, generate, copy, import or deploy is your own decision. You should get independent professional advice before trading with real money.
3. You are responsible for your trading
By using XauLab you agree that:
- every order XauLab places on your connected account is placed on your instruction, because you deployed the strategy and chose its settings;
- you alone are responsible for all trades, positions, profits and losses on your broker accounts, including losses caused by strategies running automatically while you are away;
- you will monitor your deployments and your broker account, and stop or pause them yourself when needed;
- you will test every strategy on a demo account before using real money, and only trade money you can afford to lose;
- you are responsible for choosing a broker and for making sure that trading with that broker, and the products you trade (for example forex, CFDs or gold derivatives), is legal for you where you live. Residents of India should note that the Reserve Bank of India restricts trading on many overseas forex and CFD platforms under the Foreign Exchange Management Act (FEMA).
4. No guarantee of results or of the service
Backtests and generator results are simulations on historical data. They are not real trades and do not guarantee future results. Live trading can and often does differ from a backtest because of spreads, slippage, commissions, swaps, data gaps, broker rules, latency and market conditions.
XauLab is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free, secure or accurate. Automated trading depends on systems we do not control, including your broker, MT5 servers, MetaApi, market data providers, hosting providers and the internet. Orders can be delayed, rejected, duplicated, partly filled, filled at a different price, or not placed at all. Positions can stay open if a connection fails. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose.
5. Limitation of liability
To the fullest extent permitted by law, XauLab, its owners, employees and partners are not liable for any trading loss or for any lost profits, lost opportunities, lost data, or indirect, incidental, special or consequential loss, however caused. This includes losses caused by strategy logic, software bugs, wrong or missing data, outages, delayed or duplicated orders, broker or MetaApi failures, or your own settings.
If, despite the above, XauLab is found liable to you for anything, our total liability for all claims is limited to the amount you paid XauLab in the three (3) months before the event that caused the claim.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
6. Indemnity
You agree to compensate and hold XauLab harmless from any claim, loss, penalty or cost (including reasonable legal fees) arising from your use of XauLab, your trading, your broker accounts, your breach of these terms, or your breach of any law or the rights of anyone else.
7. Your account
You must be at least 18 years old and able to enter into a binding contract. Keep your password private and use a strong, unique password; you are responsible for everything done through your account. Tell us straight away through support if you think your account has been misused.
Your broker login details are sent over an encrypted connection to the MetaApi cloud MT5 service so that strategies can run. You can disconnect your broker account at any time.
8. Acceptable use
You must not:
- break the law, or use XauLab for market manipulation, fraud or money laundering;
- try to hack, overload, scrape, copy or reverse-engineer XauLab, or get around credit, plan or security limits;
- share or resell your account, or create multiple accounts to collect free credits;
- publish or share strategies that you present as guaranteed profit or as financial advice.
9. Plans, credits and refunds
Paid plans and research credits are priced as shown on the Pricing and Billing pages at the time of purchase. Credits are used up when you run paid actions such as backtests, generator time and deployments. Failed paid research tasks are refunded in credits automatically.
Credits that have been used cannot be refunded. For any other refund request, contact support within 7 days of the payment and we will review it. Free credits have no cash value. We may change prices for future purchases.
10. Your strategies and our software
You keep ownership of the strategies you create. You allow us to store and process them to run the service, and to show them publicly only if you choose to share or publish them. XauLab's software, design and brand remain ours.
11. Suspension and closing accounts
We may suspend or close an account, or stop a deployment, if these terms are broken, to protect users or the service, or if the law requires it. You can stop using XauLab at any time. Closing your account does not close positions on your broker account; you must close them with your broker.
12. Changes to these terms
We may update these terms. When we make an important change we will ask you to accept the new version before you continue using XauLab. The date at the top shows when they were last updated.
13. Governing law
These terms are governed by the laws of India. Any dispute will be handled by the courts in India that have jurisdiction over XauLab's place of business. If any part of these terms is found invalid, the rest still applies.
14. Contact
Questions about these terms can be sent through the support chat in your workspace or the contact details on the Help page.
